This statement was sent to Axel Voss MEP, rapporteur, the shadow rapporteurs and all JURI MEPs, while they were holding discussions on article 12: “The European Writers’ Council supports the compromise amendment concerning Article 12 and Recital 36proposed by Sanasto, the Finnish Literary Copyright Society on 16/5/2018, of the draft Directive on Copyright.”
This meant that EWC endorsed especially a few key additions [italics] in Recital 36; namely,
1) that the fair compensation for uses under private copying and reprography schemes are shared between authors and publishers; 2) that there are specific systems in place to compensate for the harm caused by an exception or limitation referred in article 5.2 a or b of the 2001/29 directive; and, most importantly, the following sentence: “This provision is without prejudice to the arrangements in the Member States concerning the management of rights not based on exceptions or limitations to copyright (such as extended collective licensing schemes) and remuneration rights (such as public lending right remunerations in some Member States) on the basis of national law.”
An additional amendment endorsed by EWC referred to the inclusion of the date of the Reprobel case decision in article 12, as cut-off date to limit it to reprographic uses.
